With all respect and reverence, on behalf of my self, I would like to clarify to your court of justice the facts of the case as follows:

Indeed, the beginning of my story and tragedy was that I joined my job on 28.06.1986 in the police line of duty. At the age of 14, when I had not reached yet legal age, I practiced my duties with brother colleagues. I have always loved my job, but winds at times come against the ships’ wishes with strange problems in mode, which come only in fictitious tales or dreams. I was falsely accused and charged with writing letters opposed to the regime and blaspheming and insulting officials in the police apparatus and senior state officials.

Such letters carry in their wordings and meanings obscene expressions, like “the long toothy man”, “the long legged man”, “the chewing man”, “the spring man” referring to indecent meaning, as well as other connotations. In addition, in an advising context to an officer who is sterile and has no children, advising him if he wanted to have children that he has “to kiss horse’s anus at dawn before having tea”. Another letter narrated that “the inspector general and his assistant suffered from diabetes, and the way to treat diabetes is so simple! The inspector needs to fuck his assistant, and vice versa, the assistant should fuck the inspector. And with this successful treatment, diabetes shall go to absolute extinction from the world!”. These are some excerpts of the writings I had been falsely accused to issue that I remember having read during interrogation.

The police asked me to edit an apology letter for them in my handwriting with the incentive to be promoted to a “lieutenant” rank. I refused their request and they confined me for four months without military trial in my last year of service.

In that year, an alert was made in the general headquarters and emergencies where anthrax was sent by mail. They called the experts from the laboratory of the ministry of health to detect the unknown. The result unveiled was that the matter was ordinary powder that has nothing to do with anthrax.

This shows how “bright” such officials to become so phobic to a letter clearly marked as anthrax! Where on earth can anthrax be brought from within my country Oman? Are these the type of police force with high competence and efficiency to bear responsibility for the government in difficult situations? The women police are even braver and more efficient.

Such strange letters, which go against my values and high moral standards, were annually edited in my name. Thanks to God, I hail from conservative family of great moral traits, religious, passion for work, and love for God and his messenger. Not on one day, a bad observation has been noted on me, nor indiscipline, nor absence from work for even one day, or negligence in performing my functional duties. Even my direct in-charge acknowledged my uprightness and used to submit excellent annual reports on me. Moreover, I was nominated twice for officer cadet rank. Where are these excellent reports, which had been annually submitted on my performance? I have always had good reputation among my work colleagues, to the extent that I used to cooperate with colleagues who were in remote places or villages and worked their shifts in lieu of them in my off times. They praised me with all respect and appreciation.

What is strange was that my name was committed to paper in such letters. It is illogical and unsound that a person indicts himself in this fashion, like in the Arabic aphorism “Verily, Barakish had plunged herself into misfortune”, for a dog that barked and exposed its own people and lead to their mass slaughter.

I was dismissed from my work randomly without legal or legitimate base, on an illegal ground absolving me from responsibility, ascribing to me insanity, which is untrue. There was no medical report the police could lean on, and without medical examinations. They merely conspired against me with a medical committee forging absolute madness of 100% degree. I was baselessly degraded, humiliated, stripped off my freedom. I was repeatedly confined over and again on annual basis. This caused me great psychological, spiritual and physical harm. I became jobless and idle. I resorted to those courts in my country and was not treated with justice despite availability of evidences of the police involvement in this case.

Therefore, I resort to your honorable court of justice and call for your help. You are kindly requested to instruct me on the method or means to lodge my case before your honorable court on my address, as furnished hereunder.

The facts may be summarized as follows:

I was stripped off my freedom wrongly for sequential periods from 1994 up to 2001 without military or magistrate trials. In such arbitrary actions, I was detained for disproportionate periods: 21 days, 7 months, 6 months and 2 days, 5 months and 11 days, 9 months, 8 months and 7 days, 10 months and 14 days, 9 months, 4 months and 14 days. A matter that dictates claiming for compensation.

For disparate periods, I had been much humiliated and stripped off my rights by being imprisoned without military or magistrate trials and without legal ground, which was confirmed by the police confession with documents issued by their directorate documented with their confessions for issuing many verdicts by the Administrative Judicial Court, Muscat Primary Court, Appeal Court and the Supreme Court. The last verdict was issued on 28.03.2006. the two documents bear Nos. 2 & 3 in the case dossier. A matter that dictates claiming for compensation.

Further, the police issued another arbitrary order for detaining me for 8 days on a computer-printed letter received by mail [as proved by Document 3]. Subsequent to a blame letter including ordinary religious advices, which I sent to one of my relatives advising him that because his sister did not pray I could not marry her. This relative complained with the police station and immediately I was confined for 10 days without any trial or right [see Document 3]. A matter that dictates claiming for compensation.

Since 1994 heretofore, the police and security services have been watching me and tracking any ordinary activity I practice in a humiliating manner without any right, a matter for which I request to be compensated.

A sick certificate was issued by my place of work (the defendant) forging absolute lunacy against me. In the “so-called” medical report it is mentioned that I suffered from oppressive delusions with a feel of loftiness and psychological depression and that my mental state did not enable me to continue in the police corps or any other career. The medical committee assessed the case seriousness at the rate of 100%! [Document No. 4 in the Case File Dossier]. A matter that dictates claiming for compensation.

My medical condition was re-examined by Ibn Sina Hospital in my country where the medical report issued utterly contradicted the police “medical committee report” from top to bottom thereby proving that my referral to medical retirement was groundless. I was forcefully obligated against my will. [The document is included in the Case File Dossier]. A matter that dictates claiming for compensation.

Accusations were annually forged against me to have edited texts opposed to the ruling regime by making up and faking proof from the criminal laboratory, which was contradicted by another proof also issued by the criminal laboratory negating the same, which was a letter by the criminal laboratory director, dated 14.10.2001. I was brought for trial in two cases as scapegoat without material evidence thereby damaging my health and social status in the community discomforting me unjustifiably and with no legal grounds [Document No. 6 in the Case File Dossier]. A matter that dictates claiming for compensation.

My police directorate put me in the list of individuals banned from traveling and my identity card was confiscated for more than two years thereby breaching my personal rights and prohibiting me from traveling to continue my higher education abroad without legal grounds. A matter that dictates claiming for compensation for losing the chance to learn and insulting my tribute.

My dignity was deliberately degraded by detaining me with drug dealers and detainees of cases of breach of trust and honor despite that Articles 8 and 9 of the Military Restraint Law prohibit such disgraceful and outrageous act of detaining police officers with ordinary criminal detainees. Further, they debased my dignity once again by confining me at Ibn Sina Hospital specialized for the mentally retarded. Have you ever heard of a sane person staying with the nuts for 21 days? Is not this an excruciation much severer than whipping with lashes or life imprisonment with penal servitude? Who can imagine such scene and what happens? A matter that dictates claiming for compensation.

The judges were unfair and biased, covering up the involvement of the police apparatus and overlooking the crimes attributed to them by nepotism. They deliberately neglected documents recognized in previous and last judgments and incorporated in the case file dossier, preferring the rule of jungle, the strong eats the weak. The Caliph Omar Bin Al Khattab, may God be pleased with him said, “When have you enslaved people whom their mothers delivered free?”. But the police look for the poor and helpless to instill horror in their hearts and oppress them to become jobless and grow grey hair from their hair and beard.

I sincerely pray to God the Almighty that such officials in the police corps and the corrupt judges who are calculatingly involved in wrongdoing and neglecting their honorable duties of justice to be discharged from such honorable lines of duty. Such category of officials should not be entitled or allowed to practice such trust. They have not done justice to me despite the undeniable and clear-cut documents kept in the case file dossier by accepting kickbacks from the police apparatus and their dominion over courts by the influence of nepotism. A matter that dictates claiming for compensation.

For your kind information, they impugn the authenticity of such documents that proved their arbitrary involvements with counterfeit before both the State Administrative Judicial Court and the Muscat Primary Court. Both courts did not entertain their request to contest the authenticity of such documents with forgery. I do have copies of clear-cut and straightforward documents, which prove their involvement in the crimes ascribed to them with their admission of my backgrounds. The verdicts were issued without plunging into any point on forgery of such proving documents. Moreover, my lawyer asked them, “if there had been forgery then why are you silent about it for more than two years and have not taken any action against the plaintiff?” A matter that dictates claiming for compensation.

They have intentionally marred my reputation and wasted my dignity and future in the community and intentionally forged against me the rank of crackbrained of 100% degree. I hold them responsible for continuously wrecking my marriage scheme. Who shall be pleased to let me marry their daughter and my reputation is plunked to the ground. Can the police apparatus, and in its forefront the Inspector General, look for a suitable bride who may accept to marry me? Can they restore my esteem? A matter that dictates claiming for compensation.

They have purposely vituperated my reputation in countless occasions with false allegations and forging accusations from within my house, as I was accused at random without proof or evidence separately by two female neighbors that I had undressed for them from within my house while the woman was outside the house. There was a period of four months between the two cases. These cases were made by them without cause or justification. Hence, I was dragged into two court cases from within my own house and without any proof or evidence. I was charged in absentia for two month detention and a fine of Rials 150/-. Then we contested the judgment and was annulled without hearing two years ago for lack of material evidence. My esteem was not restored therefore. The police and public prosecutor’s office supported them without having any proof or evidence in both cases. What is my guilt such that they slander my reputation from within my house by using such women from the outside to look inside our house and separately? As the maid took advantage of the emptiness of the house from family members and attacked me inside my house, then I rightfully slapped her. I have been subjected to their plots and pursuits every now and then in the streets and even within my own house discomforting my personal life. Almost, between each four months they arrest me and exhaust me with their interrogations. I hold the police and the public prosecutor’s office full responsibility for lodging cases against me without any material proof or evidence. They did not look into the proofs and did not listen to the witnesses whom I mentioned in the investigation minutes. Moreover, many other strange officer-related incidents happened, which are not narrated in this writing for briefness. A matter that dictates claiming for compensation.

In the event the case is accepted, how much are the fees, for my knowledge, your honor.

I have with me copies of clear-cut documents, which prove their involvement in human rights infractions in crimes ascribed to them with their own confessions on my backgrounds. Moreover, in their judgments, the courts could not entertain their request in contesting my evidences with forgery, for your honor’s information, sir.

Subsequently, during litigation, I will request appearance of the involved to question them on the motives for all arbitrary actions against me and the unjustified repetitive confinements, the three inspectors along with the falsifier physician who promoted me unlawfully to the rank of 100% insane, as well as presence of the officers who detained me falsely for an advice letter and another computer-printed letter sent by mail, and the court judges involved in breach of human rights for unfairness, bias and incompetence in issuing the judgments arbitrarily to reject my case.

I have become jobless since 2001 heretofore without legal basis and unjustly, a matter that dictates claiming for compensation.

Deduction of half my salaries without right during my confinement since 1994 until 2001 arbitrarily and without legal basis, a matter that dictates claiming for compensation.

This is in addition to numerous arbitrary actions by the police apparatus, where I was transgressed by beating and slandering my dignity in my neighborhood through one of our female neighbors, as they falsely alleged that I provoked the sister of one person inside a coffee shop, and I had witnesses who disproved this malicious incidence. On the same day, they lodged two cases, one with the police station, and the other with the Public Prosecution that I chased my female neighbor in the street. Thereafter, I was detained for three days in the prison without right. This vexatious case is false, as I was walking in front of her and she was behind, and the distance between us was about eight meters, and she was holding a stone in her hand and shouting, “if you do not stop I will through this stone on you!”. Given that I always use this way to go to the mosque.

I request the honorable International Criminal Court to punish and imprison the accused involved, who detained my freedom arbitrarily without rightful reasons, the three inspectors and their assistant, the prosecutor general, the forger physician who promoted me to the rank of crazy, some police officers along with the court judges who issued arbitrary judgments without legal foundations. These are my requests, which have not come out of vacuum but are based on Article 5, Page 48 of the Human Rights book, Questions and Answers of Law Articles (the Arabic-translated version), which is issued by the globally and legally acknowledged International Criminal Court to issue judgments, imprisonment, compensation, and appearance by the accused to breach human rights before the honorable Court. A case may be lodged by an individual from 18 years of age and older.

Conclusion:

The damages and harm inflicted on me have become clear in the dispute imposed on me and the arbitrary practices of the police apparatus and their persecution against me on annual basis by repetitive imprisonment, which caused to me psychological and physical damages unjustifiably in any legal terms, in addition to material damages by deducting almost half of my remuneration annually, when my freedom had been violated by detentions for disparate periods since 1994 up to 2001 without any military or magistrate trials. All the above entails arbitrary faults of outrageous offenses and my legitimate rights not having been restored and my dues of half of my remuneration deducted not having been recovered in the past varying periods, as elaborated earlier. Accusations and charges have been fabricated against me of antagonism against my country without material evidence, as indicated in Documents 2 & 3 in the case file dossier. Moreover, I was sentenced medically of absolute madness, banned from traveling and the outcome of all this to refer me for coercive medical retirement against my will and without legal or legitimate basis, when I was at the peak of my professional performance and accomplishment. I had been deprived of nine years of possible promotion to higher position, especially that I have been qualified for this, as I am a secondary graduate and was a student at Magan College. I stopped learning because of the adverse obsessions of the case and the injustice inflicted on me. I hold them fully responsible for insulting my dignity when I was qualified to become candidate for officer rank, and as I am a man with genial sense and make poetry. Many poems of mine were published in the local papers like Oman, Al Wattan and Al Nahdha Magazine. I also practice photography and painting (drawing) natural sceneries. Moreover, I used to be a knight (horse rider) with the police. I stopped all of these hobbies because of this problem. All of these talents qualified me to hold higher ranks, but my police directorate qualified me to hold the position of crackpot with honorary premium position at 100% degree. If madness is in this level, then welcome to madness in Oman and blessed be the lunatics.

My question to them, do they settle for being wrong done, persecuted by imprisonment repeatedly on annual basis without rightful reasons, referred to medical retirement with the rank of lunatic and above all be deprived from promotion for nine years unjustly and discriminatorily.

If I were truly mad as they claim with 100% degree, my question to them is why they exhaust me with interrogations and questioning and lodge cases against me before courts in recent years after forceful retirement, as may be established in the attached documents, for your honor’s kind information.

Can you ever be pleased that a human being is persecuted, imprisoned repeatedly on annual basis, debased and his dignity is wasted in his community in this manner and form unjustly. Further, if they are really truthful in the crimes attributed to me then why they have not tried me militarily or criminally in the courts, where all legal actions have been exhausted and I was not given a just judgment. The final verdict was issued by the Supreme Court on 28/3/2006 and we demanded to have the case referred to concerned authority but our request was rejected. The courts in my country are incompetent, as the case had taken five years but my right has not been established.

Finally, you are kindly requested to acquaint me with the formalities for registering this case. With respect and appreciation, I put up my letter looking forward to my future life and career endurance between the hands of your esteemed justice. In the past, I requested the courts of country to restore my dignity and reinstate me in my job futilely.

Police has had no legal of legitimate grounds to put me into medical retirement, therefore I have requested compensation for arbitrary damages for a sum of Rials Omani One million and a half and to incorporate the previous, latter and current damages and requests in my country. Moreover, I request compensation for all litigation expenses, including lawyers and translators fees, travel and accommodation.

Therefore, I request your honor to pass judgment for compensation for Rials Omani Ten million for their great damages and their defamation of my dignity numerous times. Verily the dignity of human is priceless. False accusations touching honor were forged against me even after my forced retirement, in eight cases, by faking animosity and making up accusations inside and outside my house. They have watched the sanctity of the inside of our house from outside. Between each case and case there was a period of about four months. And another case was made up in a café. All witnesses deny such faked accusations against me, but their testimonies were not accounted for. I have been detained many times since 2001 heretofore in civil cases. Between each period of four months another accusation is made up against me. Albeit, no accusations have been made against me inside markets or at my college even though it is mixed of both sexes. Such accusations resulted in my repeated detention without right. I have been hurt and tortured psychologically. I have been exhausted with interrogations and defamations of my dignity in the community several times. As you may kindly discern, defamation of the dignity of human without right is legally punishable. I hold the defendants fully responsible for all their arbitrary acts and their support of the real culprits and faking animosities and rejecting my just case for incompetence. The judgments were issued wrongly to support the strong against the weak lest they are criminally get involved. If my country is incompetent in terms of penalizing for human right breaches, then who is competent to lodge my case before them all over the world? Is the Jin realm responsible for my case?

I request your honor to accept my case, hoping and seeking refuge to punish the criminals and tyrants.

If the fees are too high, I request to deduct them from the defendants. They should be fully responsible for their arbitrary and wrongful acts that wasted my rights and my future by wickedly misusing their powers, where they were the strong side against the weak that has no resisting defense or protection.

I am all hopes to accept my case, as the right taken by injustice shall return only by the power of justice. May goodness is bestowed upon your honor.

The first visit to Ibn Sina Hospital was on 4/4/1985, last follow-up visit was on 12/6/2002.

Symptoms: On my last meeting with above person, he was calm and tranquil in mode, and his words and actions were suitable for the situation. He denied that he has any difficulty presently or any symptoms that may indicate any specific illness.

Diagnosis: In the past, it is understood, as a result of examination and by review of the previous reports that above person suffers personality anxiety with simple psychological depression.

Treatment: No medication presently.

Recommendations: I had mentioned in a previous report on the above person that he realizes his actions and that he is responsible for his behavior. I add that he is qualified to litigate in courts without the need of legal guardian.

This report is issued on request of above person without any liability on the Hospital Management towards third parties. This is not deemed as recommendation for treatment abroad because it is incomplete and may not be presented as proof to courts or medical committee.
